Employers often fall victim to the misconception that Monthly Tax Deduction (“MTD”) computation is simple – just compute based on salary, bonus, benefit, etc. provided to the employee. However, there is much more than meets the eye. It is the employer’s unawareness of complexities of MTD computation which gives the Inland Revenue Board the opportunity to perform a payroll audit. And recently, many employers were audited by the Inland Revenue Board (“IRB”) on its extended scope of Payroll Audit.  MTD was designed for an efficient collection of tax derived from employment income. The new Section 77(C) of the Income tax Act 1967 provides that employees fulfilling certain conditions to opt MTD as final tax. However the burden of proof lies with the employer to ensure that the MTD computation is accurate.

Mr Song Liew, is a licensed tax agent under s.153(3) of Income Tax Act 1967, a MYGCAP Reviewer, a Chartered Accountant (CA) of the Malaysia Institute of Accountants (MIA), a Member of Chartered Tax Institute of Malaysia (ACTIM), a Member of the Association of Chartered Certified Accountants (ACCA), UK, a Member of ASEAN CPA and a certified trainer with HRDF.
 
He was attached to one of the international tax consultant firm in Malaysia. He has been involved in wide range of Malaysian Taxation matters including matters involving corporate and individual tax compliance, Malaysian Sales and Service Tax (“SST”) compliance, consultancy assignments, tax audit, indirect tax audit and transfer pricing assignments. He also handles advisory matters relating to employer’s statutory obligations.
 
Mr. Song manages individual’s tax compliance and advisory matters including resolving expatriates’ tax and payroll issues. He gives nationwide trainings to multinational companies, small and medium enterprises, software providers and finance magazine. He has also participated in writing articles, monthly newsletters and author to Employer Obligation 2018, SST 2.0 and Transitional Rules and Budget 2019 Tax Handbook.
 
 
Objectives

​Employers need to understand the types of information required, audit focus area, and potential risk areas to mitigate Payroll Audit by the IRB. In addition to taxes, employers need to understand other compliance requirements such as EPF, SOCSO, EIS, EI Scheme and HRDF. Employers must be proactive in ensuring that its payroll obligations are compliant to the government rulings, so not causing additional risk to businesses.
