Section 17A MACC Act 2009 introduces a new statutory corporate liability offence of corruption by a commercial organisation. Section 17A MACC Act deems any director, controller, officer, partner or who is concerned in the management of the affairs of a commercial organisation to be personally liable for the same offence if the commercial organisation is found liable.

Scope of Liability of Section 17A (1) states that a commercial organisation commits an offence if a person associated with it corruptly gives, offers or promises any gratification to any person with an intent to obtain or retain business or a business advantage for the said commercial organisation.

The burden of proof then lies on the commercial organization to prove to the Court that adequate procedures were communicated, implemented and enforced effectively within the commercial organization to prevent associated person(s) from committing an act of corruption.

Upon conviction under Section 17A MACC Act 2009, a commercial organization may be liable to a fine of not less than ten (10) times the value of the gratification in question or RM1,000,000.00, whichever is higher, or to imprisonment for a term not exceeding twenty (20) years, or to both.
At the end of this seminar, participants will be able to:

  • Initiate mitigating strategies in eliminating bribery;
  • Effectively manage a sound Anti-Bribery Policy; Strengthening the organizational core value; and
  • Take continuous strategic role in addressing bribery at workplace.

Y. BHG DATO’ HJ JALALDIN BIN HUSSAIN was the Chairman of Industrial Court in Kuala Lumpur (2006 - 31 December 2019), prior to joining MEF in June 2021 as the Senior Consultant – IR. He has vast experiences in the field of industrial relations and human resource development and management. Upon reading law with the University of Malaya in 1982, he was the Deputy Public Prosecutor (DPP) of Anti-Corruption Agency, DPP for Perak and Senior Assistant Registrar to the High Court of Johor Bharu (1983), Senior Federal Counsel of AG Chambers (1985 & 1998) and Director General of ILKAP (2000).
MR. SANTHANASAMY SUBBIAH has more than 33 years of experience in the field of financial and management accounting practices that encompasses of Banking, Manufacturing, Education, Insurance, Security, Plantation, Shipping and Freight Forwarding. He was also with the Ministry of Works involved in special projects funded by World Bank. He is now the official Consultant for more than 30 over companies under Malaysian Indian Network of Entrepreneur Association. As the Managing Director of Sun Advantage Resources, Mr Santhanasamy is the premier Consultant and conducts training programs in HRD, Taxation, Accounting and Finance, Audit Investigation, Risk Management, Corporate Governance, Legal and Compliance, Soft Skills, Supply Chain Management for numerous clienteles in the various industries.
